1. Acceptance of Terms

By downloading, installing, or using FuelStack (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a binding legal agreement between you and FuelStack. You must be 13+ years old to use the App (or the age of digital consent in your country). If you are under 18, parent/guardian consent is required.

2. Description of Service

FuelStack is a supplement tracking and reminder mobile application for iOS that provides:

  • Supplement database and information
  • Personalized recommendations based on fitness goals
  • Daily reminders and notifications
  • Streak tracking and progress monitoring
  • Supplement history and adherence tracking

The Service is provided "as-is" and may be updated, modified, or discontinued at any time. The App requires an iOS device and internet connection (some features work offline).

3. Account Registration

3.1 Account Creation

  • You must provide accurate and current information
  • You must maintain the security of your account credentials
  • You are responsible for all activity under your account

3.2 Account Termination

  • You may delete your account at any time in app settings
  • We may suspend/terminate accounts for violations of these Terms
  • Termination results in loss of all data (see Privacy Policy for retention details)

4. Acceptable Use

You agree NOT to:

  • Use the App for illegal purposes
  • Attempt to hack, reverse engineer, or compromise security
  • Upload malicious code or viruses
  • Impersonate others or create fake accounts
  • Scrape or collect data from the App without permission
  • Use the App to harm, harass, or violate rights of others
  • Circumvent usage limits or restrictions
  • Resell or redistribute the App

Violations may result in account suspension, termination, or legal action if necessary.

5. Intellectual Property

5.1 Ownership

  • FuelStack (app, website, content, design) is owned by FuelStack
  • All trademarks, logos, and brand elements are our property
  • Supplement database content is owned or licensed by us

5.2 User License

  • We grant you a limited, non-exclusive, non-transferable license to use the App
  • License is for personal, non-commercial use only
  • License may be revoked if you violate these Terms

5.3 User Content

  • You retain ownership of data you input (custom supplements, notes, etc.)
  • You grant us a license to use your data to provide the Service
  • We may use anonymized, aggregated data for analytics and improvements

6. Disclaimer of Medical Advice

IMPORTANT - READ CAREFULLY:

  • FuelStack is NOT a medical device or medical advice service
  • Information provided is for educational purposes only
  • Always consult a healthcare professional before starting any supplement regimen
  • We do not diagnose, treat, cure, or prevent any disease
  • Supplement recommendations are general guidance, not personalized medical advice
  • Do not rely solely on the App for health decisions
  • Check with your doctor about supplement interactions with medications
  • We are not responsible for adverse reactions or health outcomes

By using FuelStack, you acknowledge that:

  • You understand the App is not medical advice
  • You will consult healthcare professionals for health decisions
  • You are responsible for your own supplement choices
  • FuelStack is a tracking and reminder tool only

7. Disclaimers and Limitation of Liability

7.1 Warranty Disclaimer

  • App provided "AS IS" and "AS AVAILABLE"
  • No warranties of any kind, express or implied
  • No guarantee of accuracy, reliability, or fitness for purpose
  • No guarantee of uninterrupted or error-free service
  • Supplement database may contain errors or omissions

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are NOT liable for any indirect, incidental, consequential, or punitive damages
  • Not liable for lost profits, data loss, or business interruption
  • Not liable for health issues, injuries, or adverse reactions related to supplement use
  • Total liability limited to amount paid for the App (if any) in past 12 months

7.3 Indemnification

You agree to indemnify and hold us harmless from claims arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of third-party rights

8. In-App Purchases and Payments

8.1 Payment Processing

  • All payments processed by Apple via App Store
  • We do not store payment information
  • Refunds subject to Apple's refund policy

8.2 Pricing

  • Prices displayed in your local currency via App Store
  • Prices subject to change with notice
  • One-time purchase or subscription model (as applicable)

9. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or in-app notification. Continued use after changes constitutes acceptance.

If you disagree with changes, stop using the App and delete your account.

10. Termination

10.1 By You

  • Delete your account in app settings at any time
  • Uninstall the App from your device

10.2 By Us

We may terminate or suspend access for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Prolonged inactivity
  • Discontinuation of service

10.3 Effect of Termination

  • Your license to use the App ends immediately
  • Your data will be deleted per Privacy Policy
  • Sections that should survive termination will remain in effect

11. Governing Law and Disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Disputes will be resolved in the courts of California.

You may also pursue claims in small claims court if eligible.

12. Miscellaneous

12.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and FuelStack. They supersede all prior agreements.

12.2 Severability

If any provision is invalid, the remaining provisions stay in effect.

12.3 No Waiver

Failure to enforce a provision does not waive our right to enforce it later.

12.4 Assignment

You cannot transfer these Terms. We may assign them in case of merger, acquisition, or business transfer.
